Terms and Conditions of Use

Dear Client of Sport Press Media S.L.U:

The following Terms and Conditions of Use (the “Terms”) constitute a legal agreement between you (the “Client”) and Sport Press Media S.L.U with CIF: B24873812: , whose ownership corresponds to Marta Fernández Jiménez, with DNI 50193661W and tax address at Calle Latina 13, Bajo A Exterior, 28047 Madrid. This agreement sets forth the rights and obligations with respect to any content authorized by you on our website.

We recommend that you review these Terms and Conditions each time you purchase a content license. Sport Press Media S.L.U reserves the right to modify these Terms at any time, at its sole discretion. Any changes will be reasonably notified by email, through this page or by any other means. Modifications to the Terms will only apply to future purchases. By licensing content following such modifications, you agree to be bound by the modified Terms.

Content License

Definitions

• Content: Includes all images and editorial content available on the Sport Press Media S.L.U. website.
• Image: Photographs or other visual elements.
• Editorial Content: Photographs found in the Editorial section of our website.
• Delivery: the delivery of the purchased content is delivered immediately after payment on the platform.

Image Licenses

Part I: Editorial Image Licensing

We grant you the right to use the purchased images under the following conditions:

• Use in digital formats, written press, websites, social networks, electronic publications, among others.
• Personal and non-commercial use (not for resale or distribution).
• Right to use editorial content in a single context for one day (for example, an article or blog), as long as the content remains in its original context.
• The “single” use allows distribution in limited media, always within a specific context. Any use outside that context will require an additional license.
• Use must be for editorial purposes (information or journalistic context, excluding commercial purposes such as advertising).
• All editorial content is “for editorial use only.”

Visual Content Use Restrictions

Part II: Unpermitted Use

• The use of visual content in a manner other than that indicated in the license of the acquired image is not permitted.
• Models cannot be portrayed in an offensive manner or in inappropriate contexts such as pornography, tobacco product advertising, politics, immoral or criminal activities, among others.
• Visual content may not be used for pornographic, defamatory, libelous, misleading or unlawful purposes.
• It is not permitted to modify content with the designation “editorial use only” in a way that alters its original context.
• Content with “editorial use only” cannot be used for commercial purposes.
• Reselling, redistributing or transferring visual content is not permitted except as expressly provided.
• Visual content may not be used in a way that infringes the intellectual property rights of third parties.
• You may not use visual content as a trademark, logo or as part of an indication of origin.
• You may not falsely claim that the content was created by you or someone other than the rights holder.

Specific Restrictions for Editorial Content

Part III: Specific Use of Editorial Content

• Editorial content may only be used for descriptive, journalistic or informational, non-commercial purposes.
• It is subject to additional restrictions on distribution (for example, it is not permitted for use on television, on publication covers, or in print series).
• All editorial content is “for editorial use only.”
• The editorial content available on the Sport Press Media S.L.U website may vary, and does not guarantee that it will always be available for licensing.

Credit and Copyright Notices

Part IV: Required Credits

Whenever you use an image in an editorial context, you must include a visible and attached credit that mentions the collaborator and Sport Press Media S.L.U, in the following format:

Editorial credits must be easily legible and in a size and color visible to the user.

Guarantees and Declarations

Part V: Content Guarantees

• Sport Press Media S.L.U guarantees that collaborators have the necessary rights to license the visual content.
• The unaltered images do not infringe copyright or third party property, and are not defamatory, pornographic or illegal.
• However, Sport Press Media S.L.U does not offer guarantees about the accuracy of the keywords or descriptions associated with the content.
• Sport Press Media S.L.U will not be responsible for claims related to the inaccuracy of keywords or descriptions.

Indemnification and Liability

Part VI: Responsibilities

• Sport Press Media S.L.U reserves the right to claim compensation if the content is used improperly.
• Sport Press Media S.L.U will not be responsible for damages, losses or costs derived from modifications or the context of use of the content.
• You agree to indemnify Sport Press Media S.L.U for any damage arising from an unauthorized use of the content.

Additional Terms

Part VII: General Provisions

• Fees are non-refundable once content is purchased.
• Taxes are not included in license fees and will be added to the price of the products.
• The content is non-transferable. You may not resell, sublicense or transfer the content without express authorization.
• If unauthorized use of the content is detected, the material must be removed and Sport Press Media S.L.U notified
• If you use content for a client, you must reveal the identity of said client if Sport Press Media S.L.U requests it.
